Terms and Acceptance

1.1 By using this website (the "Site"), you confirm that you've read, understood, and agreed to follow the Terms and Conditions set by The Grow High Levels Partner (Trading as The GHL Partner). You're also agreeing to comply with local and international laws. If you don't agree with these terms, please stop using the site. The materials on this website are protected by copyright and trademark laws. The GHL Partner can change these terms anytime by updating this page, so it's a good idea to check periodically. Remember, each time you log in or make requests through our platform, you're bound by these terms and conditions.

Intellectual Property Rights

2.1 All the content on this site is owned by The Grow High Levels Partner (Trading as The GHL Partner) and is legally protected by Copyright.

2.2 Unless expressly permitted by The Grow High Levels Partner (Trading as The GHL Partner), none of the people with a running and existing contract with The Grow High Levels Partner (Trading as The GHL Partner) can be directly contacted  by the customers without the prior written permission of The Grow High Levels Partner (Trading as The GHL Partner) or the talent agency owner.

2.3 You are granted permission to download and use the materials created for the people involved with The Grow High Levels Partner (Trading as The GHL Partner) for personal, non-commercial use only, provided you do not modify the materials and that you retain all copyright and other proprietary notices contained in named materials.

2.4 This permission shall automatically terminate if you violate any of these restrictions and may be terminated by The Grow High Levels Partner (Trading as The GHL Partner) at any time. The GHL Partner reserves the right to terminate your account at any time for any reason.

Payments, Accounts, and Refunds

3.1 Automatic Subscription Renewals: To ensure uninterrupted service, we’ll automatically bill you for our Services from the date you submit your subscription and on each renewal period afterward until cancellation. Your renewal period will be equal in time to the renewal period of your current subscription. For example, if you’re on a monthly subscription plan, each billable renewal period will be for one (1) month. We’ll automatically charge you the applicable amount using the payment method you have on file with us.

3.2 Payments and Cancellations: You may cancel our services anytime. Please note that to cancel, you have to do it via your ‘my account’ tab on the left-hand side section of your dashboard. The support team can only answer questions. However, as a customer, you must take action to cancel or pause your account. Actions must be taken by you. There are no refunds for our pay-as-you-go services, and for our subscriptions, you can either Cancel or Pause. Please note the main differences between Cancelling and Pausing your subscription:

3.3 Cancelling your subscription: By cancelling your account, your design team will permanently stop working on design requests on this account, and you will lose all access to The GHL Partner Portal and links to your stored files within our secure storage cloud. All ongoing projects that are not finished will not be continued. You are responsible for ensuring you cancel your subscription before the exact cycle date and time you initially subscribed to. If you are charged and then attempt to cancel right after you have been charged, please note that the time has passed as your subscription will have started its next cycle, and you will be ineligible for any refunds. In this case, you will be able to make requests and obtain designs until the expiration of the newly paid cycle and until its remaining days. As with any other subscription service, you are responsible for keeping track of your payment cycles’ dates and times.

3.4 Pausing your subscription: This option allows you to temporarily pause design requests on your account. After your last complete active project unit cycle is finished, you will be billed a small monthly nominal fee to keep full access to your files through The GHL Partner Portal. All ongoing projects will be worked on until your last active project unit is expired. Once you reactivate your account, you can reopen tickets, and full payment of the last standing active project unit will start again. You are responsible for ensuring you pause your subscription before the exact cycle date and time you initially subscribed to. If you are charged and then attempt to pause right after you have been charged, please note that the time has passed as your subscription will have started its next cycle, and you will be ineligible for any refunds. In this case, you will be able to make requests and obtain designs until the expiration of the newly paid cycle and until its remaining days. As with any other subscription service, you are responsible for keeping track of your payment cycles’ dates and times.

3.5 Cancelling under the First 10-Hours Guarantee period: As per our Terms of Services, cancelling your membership within the First 10-Hour Guarantee bans you and your enterprise from using the services of any of the members of The Grow High Levels Partner (Trading as The GHL Partner)  for your projects, and these subscribed members cannot be in contact with you for any personal or commercial purposes whatsoever.

3.6 We will keep your logins and account active so you can access all previously submitted files until the end of your current billing period. The GHL Partner reserves the right to change our pricing and offerings at any time without prior notice.

3.7 Please note we are not a project-based platform, meaning we produce work for you and amend from your feedback on projects only as long as you are a paying customer and your account is in good standing.

3.8 Beyond the First 10-Hours window for your subscription, there are no refunds for partial subscription plans under any circumstance, including unused time on a plan. Upgrades, promotions, and/or adjustments to existing plans are non-refundable. You, the client, are responsible for using the service (The GHL Partner) after payment.

3.9 You will not be eligible for a refund if you are found not to have followed our terms of service.

Good Standing Account Defined

4.1 In order for your account to remain in good standing, you must have the correct payment card on file, and your payments cannot be delayed for more than five (5) consecutive days. As soon as your payment is delayed for 5 consecutive days or more, your account will not be considered to be in good standing. If your payment is delayed, you will be advised to either approve payment with your bank, update your card details within your dashboard, or show proof of payment in any other way we may deem appropriate.

4.2 Be mindful that once you update your card details in the system, you must let us know, and we will corroborate that payment has indeed come through to avoid any delays in the delivery of any of your ongoing work.

4.3 Please note that when payments are delayed, all involvement of the people under The GHL Partner in your projects queue will be fully stopped, including any amendments you may be missing, regardless of their importance or length of time it may take to have them done or delivered to you. People under The GHL Partner will not be involved in your projects again until payment is received.

4.4 As a subscriber, during your subscription, you are fully entitled and responsible to not having payment delays in your account. However, once your payment is delayed by at least 24 hours, we will temporarily withdraw the involvement of the people under The GHL Partner in your projects, as this is part of your paid subscription.

4.5 Please bear in mind that if we don’t receive payment from you within 5 consecutive days of a delayed payment, your account will automatically be canceled, and you will lose complete access to our assigned people for your projects. In other words, by signing up for our service, you agree to pay the fees, in such amount and for such billing frequency as specified during registration, in full before any obligation of The Grow High Levels Partner (Trading as The GHL Partner) to perform under this Agreement. In addition, you agree that, upon registering for the services through the Site, you authorize The Grow High Levels Partner (Trading as The GHL Partner) to charge your method of payment (i.e., credit card, debit card, etc.) for the fee on each anniversary of your registration date, based upon your billing frequency (i.e., monthly, quarterly, annually). Payment of the fees shall be in such amounts and at such times as set forth by The Grow High Levels Partner (Trading as The GHL Partner) through information provided to you and as authorized through the sign-up and registration process. Your account and access to the services provided via the Site may be suspended in the event of non-payment of applicable fees. You represent and warrant to The Grow High Levels Partner (Trading as The GHL Partner) that such payment information is accurate and that you are authorized to use the payment instrument. You will rapidly update your account information with any changes (i.e., a change in your billing address or credit card expiration date) that may take place.

Refund Policy Requirements

5.1 It’s our goal to provide a quality service for our customers and ensure that you have a good experience with The GHL Partner. The purpose of our First 10-Hours return policy is to ensure prospective customers have the opportunity to test The GHL Partner out risk-free. In order to protect The Grow High Levels Partner (Trading as The GHL Partner) from any possible misuse and to safeguard the integrity of our services and systems, we have listed the requirements to qualify for our refund policy:

5.2 To qualify for the refund policy, you must make yourself available to accept a call from one of our Representatives to help walk you through The GHL Partner's features and successful ways of working.

5.3 You must have at least 1 GHL Partner plan and a running project, providing as much detail as possible within the people request form.

5.4 Please note, you are free to cancel your subscription during the First 10-Hours Guarantee. However, by approving our staff on your projects, you are expressing your satisfaction with the service, meaning that a full refund is not warranted. If you did not approve any of the people form The Grow High Levels Partner (Trading as The GHL Partner) involved in your project, that means you were not satisfied with the service, and therefore, the person will be replaced without any charge, or your money will be returned to you within 5-7 business days. However, if you did approve any GHL Partner people involvement in your project during the First 10-Hours Guarantee, we will only approve a refund after a 30-business day monitoring period in which our specialized team checks the involved people provided by us is giving the expected results. Cancelling your subscription within the First 10-Hours Guarantee bans you and your enterprise from using any of the works produced by our team for your project, and these works will not be able to be used by you or anyone for any personal or commercial purposes as full Intellectual Property on these designs will belong to The Grow High Levels Partner (Trading as The GHL Partner).

Disclaimer of Warranties, Limitation of Liability

6.1 We cannot guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. Nor can we ensure that the results obtained from the service will be accurate or reliable.

6.2 You understand that we might temporarily stop or end the service at any time without warning. You agree that using the service is solely at your own risk. The service, along with all the products and services provided through it (unless we state otherwise), is provided 'as is' and 'as available,' without any express or implied warranties. This includes things like merchantability, fitness for a particular purpose, and non-infringement.

6.3 The GHL Partner and its team won't be responsible for any harm, loss, or damages related to your use of the service or products obtained through it. This includes things like lost profits, data loss, or replacement costs. Whether it's a contract, negligence, or other cases, our liability is limited to the extent allowed by law in your jurisdiction.

Non-Compete Clause

7.1 You agree not to initiate, copy, or duplicate any business model identical or similar to that of The Grow High Levels Partner (Trading as The GHL Partner), including unlimited people project involment, unlimited requests, partial hours, or 3-day delivery services, during your subscription or within the 36 months after you start using our service.

7.2 You also agree not to contact or use the company’s resources for personal or commercial benefit unrelated to the company or outside your subscription. This includes refraining from attempting to contact our staff or talent directly during or after your use of the service, or establishing a working relationship via a third party for personal or business purposes.

User Registration

8.1 Registration within the Site may be required. You commit to maintaining the confidentiality of your password and assume responsibility for all activities associated with your account. We reserve the right to remove, reclaim, or change any inappropriate, obscene, or objectionable usernames at our discretion.

Governing Law and Dispute Resolution

9.1 This agreement, including any disputes, controversies, proceedings, or claims arising from or related to it, shall be governed by and construed in accordance with American law.

9.2 Both parties agree that the courts of England shall have exclusive jurisdiction over any suits, actions, proceedings, or disputes arising from or in connection with this agreement. Each party submits irrevocably to the jurisdiction of the courts of the united States of America for such matters.

9.3 Regardless of any other provisions in this contract, the Company shall have no liability to the Client for any claim unless notice of such claim is given within 12 months after the practical completion of the Project(s) or the completion of the Services, whichever is later.

Governing Law and Dispute Resolution

10.1 The materials on The GHL Partner's website may contain technical, typographical, or photographic errors. We do not warrant that any materials are accurate, complete, or current. The GHL Partner may make changes to the materials on its website at any time without notice but does not commit to updating them.

Links & Networks

11.1 The GHL Partner has not reviewed all linked sites and is not responsible for their contents. Inclusion of a link does not imply endorsement, and use of linked websites is at the user’s risk.

Indemnification

12.1 You promise to protect and defend The GHL Partner, its team, and associates from any claims or demands by third parties. This includes covering reasonable legal fees if your actions break these Terms of Service or violate any laws or rights of others.

Severability

13.1 If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall still be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms, and the validity and enforceability of other remaining provisions shall not be affected.

Confidentiality

14.1 We keep your conversations with The GHL Partner private. Your information won't be shared with anyone unless we have a special agreement (Non-Disclosure Agreement) with you. Without such an agreement, we might showcase the work we've done for you in our marketing efforts.

Ownership, Trademarks & Provided Assets

15.1 You own all works created by your GHL Partner associate during any fully paid month. You are responsible for providing all necessary endowment according to the assigned role of the people sent by The GHL Partner, ensuring it is legally usable. The GHL Partner is not liable for materials provided concerning license or trademark issues. You agree to indemnify The GHL Partner against claims arising from (i) your breach of this Agreement, (ii) your use of the services, and (iii) infringement of third-party intellectual property rights.

15.2 You agree to indemnify and hold harmless The GHL Partner and its affiliates from claims, demands, liabilities, damages, and costs arising from (i) your breach of this Agreement, (ii) your use of the services, and (iii) infringement of third-party intellectual property rights.

15.3 If you cancel your subscription within the trial period, works created during this time must not be used for any purpose and will be surrendered exclusively to The Grow High Levels Partner (Trading as The GHL Partner).

Sample Work

16.1 By default, you grant The GHL Partner a non-exclusive right and license to publish your work in our portfolio, social media, or other communications. All work may be publicly accessible unless you notify us in writing otherwise.

Creative Cycles

17.1 A creative cycle measures output based on the complexity and volume of requests. It begins when a request or revision is assigned through the People Request Form. Requests must be clear, detailed, and include required assets and information to be assigned. While we aim to deliver on your timelines, there is no guarantee.

Delivery Output

18.1 You may submit unlimited people assignation requests, stored and prioritized. Our team picks and selects the required GHL Partner peopleaccording to your purchased plan. We can only select and pick more than 2 people for your project if your subscription is the customized plan. You can Pause or Cancel a project to move to the next one. This is also applicable to the amount of projects a GHL Partner Associate is involved.

18.2 GHL Partner associate assignment for multiple projects in a request follows a schedule provided by your account manager. The team operates daily, except for December 24th (12:00 pm EST to December 25th, 11:59 pm EST) and December 31st (12:00 pm EST to January 1st, 11:59 pm EST).

Offers & Promotions

19.1 You can use one promotion at a time, and you can't combine multiple promotions. If you made a payment during a promotion or discount, refunds aren't available after 7 days.
